Terms of Service
Effective Date: 15 August 2025
Welcome to D10 Media Network (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of our website www.d10medianetwork.in (“Site”) and the services we provide, including digital music distribution, music promotion, artist promotion, digital marketing, social media management, and YouTube channel management (collectively, “Services”).
By using our Services, you agree to these Terms. If you do not agree, do not use our Services.
1. Eligibility
Our Services are for music owners, rights holders, and producers who have the legal authority to distribute and promote the music they submit. You must be at least 18 years old or have parental/guardian consent to use our Services.
2. Agreements and Content Rights
Before we distribute your music, we enter into an agreement with you as the content owner, rights holder, or producer. This may happen before distribution starts or during reporting and payment cycles.
You confirm that:
-
You are the actual licensor of the content or have full legal rights from the owner/producer to submit it.
-
You must provide original content for distribution or publishing (music, artwork, lyrics, compositions, music videos, poems, lyrical videos, or any other content), along with full credits and details for each submission.
-
The content you provide does not infringe any third-party rights or laws.
You retain ownership of your music and intellectual property. By submitting content, you grant us full rights to distribute, monetize, and promote it worldwide across all DSPs and partner networks.
3. Content Responsibility
If any artist, manager, label, sub-label, partner, or content provider submits a cover song, mashup, duplicate version, or any other version of content (audio or visual) that partially or fully matches content previously distributed or published by another party:
-
We, including our team, DSPs, platforms, and service providers, are not liable for any copyright issues, disputes, or claims.
-
Full responsibility lies with the content provider, owner, licensor, and all creators involved.
-
We normally do not distribute such content. If you want us to, you must provide proper written legal permission from the original rights holder(s), including label, lyricist, composer, and producer/production house.
-
Even with permission, distribution will be subject to our internal approval and conditions.
-
If such content is distributed by us unknowingly, we are not responsible for any resulting issues.
-
We may withhold royalty payments if the content is not exclusive (applies mainly to original works).
We also reserve the right to take action, request removal, or process takedowns of any unauthorized use of our content (in part or in full) found on any platform if we determine it causes harm or loss to our business.
4. Distribution and Monetization
We distribute your music to major DSPs and partner platforms, and may monetize it through YouTube Content ID, social media, and other channels.
We promote your music and artists to maximize reach and engagement.
5. Account and Channel Management
When we create or manage an account or channel (including YouTube or other social media profiles) for you:
-
Your cooperation is essential, and you must follow our guidelines and platform rules.
-
Do not share your login credentials with others. If you do, you are responsible for any resulting loss or damage.
-
You must grant us exclusive permission to manage and operate your account or channel for the agreed period.
6. Royalty Payment and Reports
Royalty percentages vary by service type. All services have a minimum percentage cut retained by us, with the majority paid to the artist, producer, label, or partner.
Streaming reports and payments are generally provided within 3–4 months after we receive them from DSPs and partners, though some cases may take longer.
We aim to provide all reports and payments in a timely and transparent manner.
7. Term and Termination
Our music distribution agreements auto-renew annually from the date of signing.
-
To terminate, you must notify us in writing.
-
Termination is not allowed in the first year of the agreement.
8. Use of Services
You agree not to:
-
Submit unauthorized, infringing, or illegal content.
-
Engage in fraudulent streaming or activity that manipulates DSP metrics.
-
Use our Services for unlawful purposes.
We may suspend, terminate, or take legal action if these Terms are violated.
9. Limitation of Liability
We are not liable for indirect, incidental, or consequential damages arising from your use of our Services. Our total liability is limited to the royalties owed to you, if any, for the relevant period.
10. Governing Law
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Guwahati, Assam, India.
11. Changes to Terms
We may update these Terms at any time. Updates will be posted on this page with a new effective date. Continued use of our Services means you accept the changes.
